Festy for Teams Terms of Service
Effective and last updated: 24 October 2026
These terms are an agreement between FESTY LTD (“Festy”), company number 15123095, 20 Wenlock Road, London N1 7GU, and the company that creates a Festy for Teams account (“you”). They cover the Festy for Teams portal at teams.myfesty.io and the company gifts sent through it. Festy’s Terms of Service still apply to each employee’s own use of the Festy app. The Data Processing Agreement below forms part of these terms.
1. Your account
- Festy for Teams is invite-only. You can create an account only with an invite code from Festy.
- The person who creates the account confirms they may bind your company to these terms.
- Admins are the people with portal access. You are responsible for what they do in the portal and for keeping their passwords private.
- Tell us at info@myfesty.io straight away if you think someone has used your account without permission.
2. Your balance and top-ups
- Gift cards are paid from your company balance. You add money by card, Apple Pay or Google Pay, processed by Stripe.
- Each top-up shows the amount added to your balance and a card processing fee (currently 1.5% + 20p) before you pay. The fee covers the card company’s charge, so the full amount you add is available for gifts.
- During the pilot, Festy charges no fee of its own. We will give you at least 30 days’ notice by email before introducing or changing any Festy fee.
- Your balance does not expire and earns no interest. It can only be used for gifts through Festy for Teams.
3. Sending gifts
- A gift card is paid from your balance when it is issued: straight away for gifts sent now, and on the day for scheduled and automatic gifts.
- If your balance is too low on the day, the gift waits and is sent the morning after you top up. We email your admins when your balance won’t cover the next 14 days.
- Gift cards are supplied through our partner Tillo and issued by the named brand. Once issued, a card is the recipient’s, and the brand’s own terms apply to using it.
- Issued gift cards cannot be cancelled or refunded. You can cancel a scheduled gift in the portal any time before it is issued.
- You are responsible for choosing the brand, amount, message and recipients. Messages must not be unlawful, offensive or misleading.
4. Refunds of unused balance
- If you close your account, we refund your unused balance to the card that paid for it, or by bank transfer, within 30 days of your request.
- Card processing fees you have already paid are not refunded.
- If a gift card fails to issue, its value goes back into your balance automatically.
5. Your employees’ information
- You may upload names, work email addresses, birthdays and start dates of people you employ, only so Festy can celebrate them for you.
- You confirm you have told them, and have a lawful basis, as required by data protection law. Our privacy note for employees helps you do this.
- Festy handles this information as your processor under the Data Processing Agreement, which forms part of these terms.
- When an employee joins with their own Festy account, that account and what they add to it are theirs and Festy’s, under Festy’s Privacy Policy. They can leave your company on Festy at any time.
6. Service
- We aim to keep Festy for Teams available and to send scheduled and automatic gifts at 6am UK time on the day, but we don’t promise uninterrupted service.
- We may change or improve features. We will tell you in advance about any change that materially reduces what you have paid for.
7. Liability
- Nothing in these terms limits liability for death or personal injury caused by negligence, for fraud, or for anything that cannot be limited by law.
- Otherwise, Festy’s total liability to you in any 12 months is limited to the total of your top-ups in that period.
- Festy is not liable for loss of profit, business or goodwill, or for indirect loss.
- Festy is not responsible for a brand refusing or failing to honour its gift card, but we will help you raise it with Tillo and the brand.
8. Ending the agreement
- You can close your account any time by emailing info@myfesty.io. Scheduled gifts that have not been issued are cancelled.
- We may suspend or close an account for serious or repeated breach of these terms, fraud, or non-payment, with notice where we reasonably can.
- On closure, we refund your unused balance (section 4) and delete your roster under the Data Processing Agreement.
9. General
- We may update these terms. We will email your admins at least 30 days before a change takes effect; continuing to use Festy for Teams after that means you accept it.
- These terms are governed by the law of England and Wales, and the courts of England and Wales have exclusive jurisdiction.
- Contact: info@myfesty.io.
Data Processing Agreement
This agreement forms part of the Festy for Teams Terms of Service. Under UK GDPR and the Data Protection Act 2018, the company is the controller of the employee information it uploads, and Festy is its processor.
What Festy processes
| People | The company’s employees and admins |
|---|---|
| Information | Name, work email, birthday (day and month), work start date, team status, gift history and gift messages; admin names, emails and passwords (stored hashed) |
| Purpose | Showing upcoming birthdays and work anniversaries, sending gifts and reminders, and inviting employees to join on Festy |
| Duration | While the company’s account is open, then deleted as below |
Festy’s commitments
- Process the information only on the company’s documented instructions, which are these terms and its use of the portal.
- Make sure staff with access are bound by confidentiality.
- Keep the information secure: encrypted in transit (HTTPS), access limited to people who need it, admin passwords hashed, gift card links kept from admins.
- Help the company answer employees’ requests to access, correct or delete their information.
- Tell the company without undue delay, and within 48 hours of becoming aware, of a personal data breach affecting its information.
- Use only the sub-processors below, and give 30 days’ email notice before adding or replacing one, so the company can object.
- On request, give the information needed to show compliance with this agreement.
Sub-processors
| Sub-processor | What for | Location |
|---|---|---|
| Heroku (Salesforce) | Hosting the portal and servers | Ireland (EU) |
| MongoDB Atlas | Database | Available on request |
| Klaviyo | Sending emails to admins and employees | United States |
| Tillo | Issuing gift cards (recipient name and email) | United Kingdom |
| Stripe | Taking top-up payments (admin’s payment details) | United States / Ireland |
Where information leaves the UK, Festy relies on UK adequacy regulations or the UK International Data Transfer Addendum.
When an employee joins Festy
When an employee joins with their own Festy account (a company code or the link in a company gift), Festy links that account to their roster row. From then on, the account and anything they add to it (wishlist, favourite brands, friends) are handled by Festy as controller under its Privacy Policy. The company sees only that they have joined, never their app activity.
Deletion
- Admins can remove a person from the roster at any time.
- Within 30 days of the company closing its account, Festy deletes its roster and admin accounts, except records it must keep by law (such as payment and gift records for tax, kept up to 6 years).
